Terms of Service
PEO Fit Check is operated by WR Machine, LLC ("we," "us"). By clicking a submit button on peofitcheck.com, you agree to these Terms. If you are acting for a business, you confirm you have authority to bind it, and "you" includes that business. You can answer the questions and see your result without submitting anything.
1. What PEO Fit Check is
A free screening tool. You answer a few questions about your business. We show a general indication of whether a PEO is worth evaluating and a general cost range for businesses of your size. If you ask, we introduce you to up to three PEO providers ("Providers") selected from our network based on your answers.
2. What we are not
We are not a PEO. We are not an insurance agent, broker, or producer; we hold no insurance license; and we do not sell, quote, or bind insurance. Nothing on this site is legal, tax, HR, benefits, or insurance advice. Your result is a general indication, not a recommendation to sign with anyone. The cost range is an estimate drawn from public industry data, not a quote; each Provider sets its own pricing and terms.
3. How we make money
The service is free to you. Providers pay us for introductions. Depending on our agreement with a Provider, it may pay us a fee for each introduction, a fee if you become its client, or both. Any fee tied to your becoming a client is calculated only on the Provider's administrative-services charges, never on insurance premiums, benefit premiums, or payroll taxes. We therefore have a financial interest in your requesting introductions and in your becoming a Provider's client. Compensation does not affect your result or which Providers we select. Our network does not include every PEO; consider Providers outside it as well.
4. Introductions
We send an introduction only when you click the button on the introduction form, and we send it at that moment. We do not identify the individual Providers before you submit. An introduction includes your name, company, work email, phone, role, a summary of your answers, your result and fit score, and the consent record described in our Privacy Policy. We will not send your information to additional Providers without a new request from you. We will tell you which Providers received it once a match has been made. Asking for your result by email is not a request for an introduction and sends nothing to a Provider.
5. Contact permission
The introduction form describes the calls, texts, and emails you are agreeing to receive from the Providers that receive your introduction, and from us, including calls and texts made with automated technology or a prerecorded voice. That form controls; these Terms do not expand it. Permission is not a condition of buying anything from anyone, and message and data rates may apply. To stop contact, tell us by sending your request to [email protected], reply STOP to a text, or tell the caller. We stop our own contact promptly and forward your request to the Providers that received your introduction within five business days. You may also contact a Provider directly.
6. Your responsibilities
Give accurate information, and submit only contact details you are authorized to submit. Do not enter information about individual employees, health or medical information, payroll or census files, account numbers, or tax IDs; if a Provider needs those, give them directly to the Provider. Do not scrape, reverse-engineer, or misuse the site. Verify every Provider yourself, including its licensing in each state where you have employees, before signing anything. Any agreement with a Provider is between you and the Provider; we are not a party to it.
7. Our content
The site, questions, result logic, and cost model belong to us. You may save your result and share it within your business and with your advisers. Any other use requires our written permission.
8. No warranties; limits on liability
The site is provided "as is." We do not guarantee its accuracy or availability, that any Provider will respond, or how any Provider performs. To the fullest extent the law allows, we are not liable for indirect, consequential, or punitive damages, and our total liability to you is limited to $100. This does not limit liability for our own fraud, gross negligence, or willful misconduct, or any liability the law does not allow us to exclude. Providers are independent businesses; we are not responsible for their acts, or for the actions of insurers, plan administrators, or regulators.
9. Indemnity
You will defend and hold us harmless from third-party claims to the extent caused by your breach of these Terms, false information you knowingly supply, contact details you submit without authorization, or your agreement with a Provider. This does not cover losses caused by our own fault.
10. Disputes
These Terms are governed by Wyoming law. Before bringing any claim, one side sends the other a written description of the dispute, and both try to resolve it for 60 days. Any dispute that remains is resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, held in your business's home county or by video. Claims may be brought only on an individual basis, not as a class or representative action. You may opt out of arbitration by emailing within 30 days of first agreeing to these Terms; if you do, disputes go to the state courts in Sheridan County, Wyoming or the U.S. District Court for the District of Wyoming
11. Changes and general terms
We may change these Terms. For material changes we give at least 30 days' notice by email to people who have given us an address and ask you to agree again before any new submission. Changes do not expand permission you already gave. If any part of these Terms is unenforceable, the rest stands. You may not assign these Terms; we may assign them with our business. These Terms, together with any permission you give on a form, are the whole agreement about the site. The Privacy Policy is a notice of our practices, not something you consent to as a whole. The site is intended for businesses in the United States.
